Welcome to Race DNA.

These Terms of Service govern your use of our website and any purchases made from Race DNA. By accessing our website or placing an order, you agree to these Terms.

In these Terms, “Race DNA”, “we”, “us” and “our” refer to Race DNA.

1. Our Products

Race DNA creates personalised products made to order based on the information you provide when purchasing.

Because each personalised item is produced specifically for an individual order, please carefully review all personalisation details before completing your purchase.

Product photographs and digital previews are intended to represent our products as accurately as reasonably possible. Small differences in appearance, positioning, finish, colour or engraving may occur due to materials, manufacturing processes, screen settings and the personalised nature of the product.

These reasonable variations are not necessarily considered defects.

2. Personalisation Information

You are responsible for checking the information you submit with your order, including names, race details, finishing times, dates and other personalised content.

We produce personalised items based on the information submitted with your order.

If you realise that you have submitted incorrect information, contact us as soon as possible at hello@theracedna.com.

We will do our best to make changes if production has not yet begun, but we cannot guarantee that an order can be changed after it has entered production.

If we make an item differently from the information correctly submitted with your order, please contact us and we will work with you to resolve the issue.

3. Orders

Submitting an order through our website does not prevent us from cancelling an order where there is a genuine reason we cannot fulfil it.

For example, we may cancel an order if:

A product becomes unavailable
There is an obvious pricing or technical error
We reasonably suspect fraudulent or unauthorised activity
The order contains content that we cannot legally or reasonably reproduce
We are otherwise unable to fulfil the order

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.

4. Pricing & Payment

Prices are displayed on our website in the currency shown to you at the time of purchase.

Applicable taxes may be included in the displayed price or calculated during checkout depending on your location and the requirements of applicable law.

You agree to provide current and accurate billing and payment information when placing an order.

Payments are processed through third-party payment providers. Your bank, card issuer or payment provider may separately apply currency conversion or other charges that are outside our control.

5. Production & Processing

Race DNA products are made to order and require production time before they are dispatched.

Estimated production and delivery times displayed on our website are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

Where Priority Processing is offered, it means that your order receives priority during our production and processing workflow. It does not guarantee a particular delivery date or faster performance by postal or courier services unless expressly stated.

6. Shipping & Delivery

We work with third-party delivery and logistics providers to deliver orders internationally.

Delivery times may be affected by factors outside our reasonable control, including carrier delays, customs processing, local delivery conditions, weather and peak shipping periods.

We will provide available tracking information when your shipment reaches the stage at which tracking becomes available through our delivery network.

If you experience a significant delivery issue, contact us at hello@theracedna.com and we will assist where reasonably possible.

Nothing in this section limits any rights you may have under applicable consumer law in relation to delivery.

7. Changes, Cancellations, Returns & Refunds

Because Race DNA products are personalised and made to order, change-of-mind returns are generally not available once production has begun.

If your order arrives damaged, defective or incorrectly made, please contact us so that we can review the issue and provide an appropriate solution.

Our detailed rules regarding changes, cancellations, replacements and refunds are set out in our Return & Refund Policy, which forms part of these Terms.

Nothing in these Terms or our Return & Refund Policy excludes any consumer rights that cannot legally be excluded.

8. Product Availability & Website Information

We make reasonable efforts to ensure product descriptions, images, prices and other information on our website are accurate.

Occasionally, information may contain an error or become outdated.

If we discover a material error affecting an order you have already placed, we will contact you where appropriate and offer a reasonable solution, which may include correcting the order or providing a refund.

9. Appropriate Use of Our Website

You must not use our website:

For unlawful or fraudulent purposes
To interfere with the security or operation of the website
To introduce malicious code or attempt unauthorised access
To scrape, copy or reproduce substantial parts of the website without permission
To infringe the intellectual property or other rights of Race DNA or another person

We may restrict access where reasonably necessary to protect our website, customers or business.

Unless otherwise stated, the Race DNA name, website content, product designs, graphics, photographs, copy, layouts and other original materials appearing on our website are owned by or licensed to Race DNA.

When you provide personalisation information to us, you give us permission to use that information only as reasonably necessary to produce, fulfil and support your order.

Our website relies on third-party services including Shopify, payment providers, analytics services, production partners and delivery providers.

Some website features may also link to third-party websites or services.

Those third parties may have their own terms and privacy practices. Race DNA is not responsible for the independent content or practices of third-party websites that we do not control.

We handle personal information in accordance with our Privacy Policy.

By using our website or placing an order, you acknowledge that information may be processed by service providers involved in operating our store, processing payments, producing personalised products and fulfilling deliveries.

13. Consumer Rights

Our products and services come with rights and guarantees that may apply automatically under consumer protection laws.

Nothing in these Terms is intended to exclude, restrict or modify any right, guarantee, remedy or liability that cannot lawfully be excluded or restricted.

For Australian customers, this includes rights available under the Australian Consumer Law.

To the maximum extent permitted by law, Race DNA is not responsible for losses that are indirect, unforeseeable or not reasonably connected with our failure to perform an obligation.

We may update these Terms from time to time to reflect changes to our products, services, business operations or legal requirements.

The Terms that apply to your purchase are the Terms in effect when your order is placed, unless a change is required by law.

These Terms are governed by the laws applicable in Victoria, Australia.

However, this does not prevent you from relying on any mandatory consumer protection rights that apply to you under the laws of the country or region where you live.
